1. Acceptance of Terms

Accessing and using the website vivirdonde.com (hereinafter, "VivirDonde" or "the Service") implies full and unreserved acceptance of these Terms of Service. If you do not agree with any of these terms, please do not use the website. Continued use of the Service after modifications are published constitutes acceptance of such changes.

2. Description of the Service

VivirDonde is a free neighborhood comparison tool for the rental market in the Madrid Region. The Service provides:

• An interactive neighborhood recommender based on budget, location and lifestyle preferences.
• Interactive rental price maps by area.
• Indicative financial calculators (affordable rent, mortgage simulator).
• Comparative neighborhood scores (safety, transport, green spaces, nightlife, etc.) based on official public sources.
• Descriptive profiles for each neighborhood and district in the Madrid Region.

The Service is offered free of charge and without direct commercial purposes towards the user. Funding may come from non-intrusive contextual advertising.

3. User Accounts and Responsibilities

Some features of the Service may require creating a user account via OAuth authentication (Google). The user agrees to:

• Provide truthful and up-to-date information.
• Maintain the confidentiality of their access credentials.
• Use the Service lawfully and in accordance with these Terms.
• Not attempt unauthorized access to systems, data or functions of the Service.
• Not use automated tools (bots, scrapers) to extract data from the site without prior written authorization.

The user is solely responsible for activities carried out from their account and for decisions made based on information provided by the Service.

4. Intellectual Property

All website content (design, code, texts, graphics, logos, structure, data compilation and scoring algorithms) is the property of the Owner or used under license, and is protected by Spanish and international intellectual and industrial property law.

Source data for neighborhoods and prices comes from official open sources (Madrid City Council, CRTM, SERPAVI/INE, Idealista) and is collected under their respective licenses. The compilation, transformation, scoring algorithm and visual presentation constitute original work of the Owner.

Total or partial reproduction, distribution, public communication or transformation of the content is prohibited without the express authorization of the Owner, except for personal and private use.

5. Limitation of Liability

The recommendations, scores and price estimates provided by VivirDonde are exclusively for informational and indicative purposes. They do NOT constitute professional real estate, financial, legal or any other type of advice.

The Owner does not guarantee the accuracy, completeness, currency or suitability of the data displayed for any particular purpose. Rental prices are estimates based on aggregated market data and may differ significantly from actual prevailing prices.

In no event shall the Owner be liable for direct, indirect, incidental, special or consequential damages arising from the use or inability to use the Service, including, without limitation, rental, purchase or investment decisions based on the information provided herein.

Users are strongly encouraged to personally visit areas of interest and consult with qualified professionals before making any real estate decisions.

6. User-Generated Content

When using features such as the recommendation wizard, anonymous surveys or saved preferences, the user may provide data to the Service. By doing so, the user:

• Guarantees that the data provided is truthful and does not infringe on third-party rights.
• Authorizes the Owner to use survey data anonymously and in aggregate to improve the Service, as described in the Privacy Policy.
• Accepts that saved preferences and recommendation results are stored for their convenience and may be deleted at the user's request.

7. Data Provided "As Is"

All information on the Service is provided "as is" and "as available". The Owner makes no warranties of any kind, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose or non-infringement. The Owner does not warrant that the Service will be error-free, uninterrupted or virus-free, or that the results obtained will be accurate or reliable.

8. Termination

The Owner reserves the right to suspend or terminate access to the Service at any time and without prior notice, especially in the event of a breach of these Terms of Service.

The user may stop using the Service at any time. If they have an account, they may request its deletion and the deletion of all associated personal data by sending an email to [email protected].

9. Governing Law and Jurisdiction

These Terms of Service are governed by Spanish law. For the resolution of any dispute arising from the use of the Service, the parties submit to the Courts and Tribunals of the city of Madrid (Spain), expressly waiving any other jurisdiction that may apply.

11. Internal Analytics and Service Improvement

VivirDonde internally records certain service usage events (account registration, login, newsletter sign-up, alert creation, recommendation wizard usage) for the sole purpose of improving the service and ensuring account security. This processing is based on the legitimate interest of the controller (Art. 6.1.f GDPR).

These records are made in the server-side database and do NOT use cookies or client-side tracking technologies. No IP addresses are stored. Income data is processed only as an anonymized range. The user may object to this processing by sending an email to [email protected].
